WHAT TO AVOID

Don't fall into these traps.

Merchant cash advances.

An MCA is not a loan — it is a sale of your future receipts at a steep discount, collected by daily debits. Legal, fast, and the most common way a working operator here gets buried. If an unsolicited broker offers funding based only on your bank statements, this is the product.

Stacking.

A second and third advance to service the first. Three sets of daily debits empty an account faster than any harvest can refill it. If you are already in one, call **Ventura County Community Development Corporation** about refinancing before you take another.

Upfront fees.

Legitimate lenders do not demand a large payment before funding. Application fees are small and disclosed in writing. A demand for hundreds or thousands to "release" your loan is a scam.

Crop and equipment advances from the buyer you sell to.

Advances against a future harvest from a packer or a broker can be reasonable or can be a trap with a price attached. Get the terms in writing and compare them against a CDFI loan before agreeing.

Immigration pressure and fixers.

Anyone who says your status disqualifies you unless you pay extra, or who offers to "handle" your ITIN or documents for a fee, is working an angle. ITIN lending is ordinary lending where it is offered.

Title loans for payroll.

Your work truck's title against a short-term loan risks the asset your income depends on.

Urgency.

No real offer expires today. Ask for the total dollars repaid, not just the rate — and if they will not put that number in writing, leave.

California-Specific Notes Worth Knowing

The rules where you are.

Registration.

LLCs and corporations form through the California Secretary of State; a sole proprietor operating under a business name files a fictitious business name statement with the county clerk; the state tax agency issues a seller's permit if you sell goods.

Licensing is stricter here than most states, and it cuts both ways.

California's contractors' licensing board licenses construction trades above a small threshold. California also licenses farm labor contractors — a requirement that catches many crew operators by surprise and that lenders and growers both check. Getting licensed is usually the highest-return move available to an unlicensed operator: it changes what work you can take and whether anyone will finance you.

The state loan guarantee.

California guarantees certain small-business loans through financial development corporations. If a lender hesitates on your file, ask directly whether a state guarantee can be attached to it. That single question has rescued a great many borderline applications.

Your language rights.

California law requires that when a loan is negotiated with you primarily in Spanish, you be given a written translation of the key terms before signing. If a broker sells you in Spanish and then hands over English-only documents, you can ask for the Spanish version. That is a right, not a favor.

Payroll and labor rules.

Workers' compensation is mandatory if you have employees, and agricultural labor in California carries additional wage, hour and heat-illness requirements. Paying crews in cash off the books costs more than it saves — in insurance exposure, in licensing risk, and in the loan you cannot document your way into.

Water.

For growers and nursery operations, water cost and reliability are part of every serious lending conversation in this county. Have your water situation documented before you ask for money against a crop.
