Don't fall into these traps.
Delta County residents, like people in many rural areas, can be targets for lenders that charge far too much or use confusing terms to hide the real cost of borrowing. Here is what to watch for:
Even with Colorado's 36% cap, payday loans are expensive and designed to roll over — meaning you keep paying fees without reducing the principal. Avoid them if at all possible. A credit-builder loan from a local credit union is almost always a better path.
Some online lenders operate illegally or operate under tribal charters specifically to avoid state rate caps. If a lender charges more than 36% APR and claims Colorado law does not apply to them, that is a serious warning sign. Check DORA before applying anywhere online.
Legitimate lenders do not tell you to 'act now' or warn you that an offer expires in minutes. Good rates do not vanish overnight. If someone is pushing you to sign fast, walk away.
Some lenders encourage you to refinance an existing loan before it is paid down, adding new fees each time. This keeps you in debt longer without benefiting you.
No legitimate lender will ask you to pay a fee or 'insurance' using a prepaid debit card or gift card before receiving a loan. This is a scam, every single time.
No lender can legally guarantee approval without reviewing your income and credit. Any lender that does is likely hiding something in the fine print.
Never sign a loan document with blank spaces. Fill everything in, or cross it out, before you sign. When in doubt, bring documents to a CDFI advisor, a SCORE mentor, or the Western Colorado SBDC before signing anything.
The rules where you are.
Colorado has some of the stronger consumer lending protections in the mountain west. Here is what applies to you as a Delta County resident:
Colorado's Uniform Consumer Credit Code (UCCC) limits the annual percentage rate (APR) on most consumer loans. As of recent law (Colorado HB21-1390), payday and small-dollar loans are capped at 36% APR for loans up to $3,000. This is a significant protection — some states allow 300%+ APR payday loans, but Colorado does not.
Under Colorado law, lenders cannot charge unreasonable prepayment penalties on most personal loans. If you want to pay off your loan early, you generally can without being penalized.
