Many applicants are seasonal workers, gig workers, or solo contractors whose income doesn't come from a single W-2 employer.

**General eligibility factors most lenders consider:**
- Proof of income (W-2, 1099, bank statements, or profit-and-loss for self-employed individuals)

New York State–Specific Regulatory Notes
New York State has some of the strongest consumer lending protections in the country. Understanding these rules helps you recognize a fair deal and walk away from an unfair one. **Interest rate cap:** New York State imposes a civil usury cap of **16% APR** on most personal loans made by non-bank lenders to individuals. Licensed banks and credit unions may charge somewhat higher rates under federal preemption, but New York's Department of Financial Services (DFS) actively enforces this cap on non-bank lenders. If a non-bank lender quotes you a personal loan above 16% APR, ask questions. **Criminal usury threshold:** Charging more than **25% APR** on a personal loan to an individual is a criminal offense in New York State under Penal Law § 190.40. This is important: many online lenders operating outside New York try to evade this law through arbitration clauses or tribal lending arrangements. If a lender's rate exceeds 25%, stop the conversation. **Payday loans are effectively banned:** New York State does not license payday lenders. Storefront payday lending is not legal here. If you see something that looks like a payday loan — advances due in full on your next paycheck at very high fees — it is almost certainly operating illegally or through a loophole. Report it to the NYDFS at dfs.ny.gov. **Banking access and the Bank On program:** New York supports the national Bank On initiative, which helps unbanked residents open safe, low-fee checking accounts. In New York, credit repair organizations cannot charge you before they have completed their services. If someone asks for $200–$500 upfront to "fix" your credit, walk away. Free credit counseling is available through nonprofit agencies — ask PathStone or any local CDFI for a referral.
**4. Loan flipping**
Some lenders encourage you to refinance a loan before it's paid off, adding new fees each time. This keeps you in debt longer and costs far more than the original loan. Ask any lender: *"What is the total cost of this loan if I make every scheduled payment?"* Get the answer in writing.
**5. Prepayment penalty traps**
New York law limits prepayment penalties on many loan types, but some lenders still include language that discourages early payoff. Read the loan agreement before signing. A community lender or credit union typically will not penalize you for paying early.
**6. Urgency pressure**
No legitimate lender will tell you that an offer expires in 24 hours or that you must decide today. Take the time you need. Compare at least two offers. There is no financing emergency that requires a same-day signature.
**7. "Ghost" lenders asking for upfront fees**
If a lender says you must pay a processing fee, insurance fee, or deposit before receiving your loan funds, stop. This is an advance-fee scam. Legitimate lenders deduct fees from the loan proceeds — they do not collect money from you before disbursing a loan.
