WHAT TO AVOID

Don't fall into these traps.

Burke County residents — especially immigrants, seasonal workers, and people with damaged credit — are sometimes targeted by lenders whose products cause more harm than good. Here is what to watch for:

1. Online "tribal" or offshore payday lenders

Some online lenders claim tribal sovereignty or offshore incorporation to avoid NC's interest rate cap and payday ban. They may advertise APRs of 200%–600%. 2. Rent-to-own stores

Stores that offer furniture, electronics, or appliances on weekly payment plans often carry effective APRs of 100%–300%. If you need a household item, a personal loan from a credit union is almost always cheaper.

3. High-cost installment lenders (storefront)

Some storefront consumer finance companies are licensed in NC but charge rates close to the 30% cap and add heavy origination fees, credit insurance, and other add-ons that inflate the true cost. Always ask for the APR (Annual Percentage Rate), not just the monthly payment.

4. Loan flipping

A lender encourages you to refinance your personal loan before it is paid off — each time adding fees. The balance never seems to go down. Walk away from any lender who pressures you to refinance.

5. Upfront fee scams

Legitimate lenders do not ask you to pay a fee before receiving your loan. If someone asks for a "processing fee," "insurance payment," or "wire transfer to unlock your loan" before you receive funds — that is a scam.

6. Pressure and urgency

A good lender gives you time to read the contract, ask questions, and compare offers. Any lender who says "this offer expires today" or rushes you to sign is a warning sign. You always have time to think.

7. Co-signer abuse

Be cautious about co-signing for someone you do not fully trust. In NC, a co-signer is equally liable for the debt. A default will damage both credit profiles and can lead to wage garnishment for the co-signer.

Your best protection. Use the NC Commissioner of Banks license lookup (nccob.nc.gov) before borrowing from any lender you found online or through an unsolicited offer.

Interest Rate Cap (Usury Law)

North Carolina General Statutes § 24-1 and related statutes cap interest rates on most personal consumer loans. For loans under $25,000 made by licensed lenders, the rate cap is generally 30% APR. This is important: it means truly predatory triple-digit APR payday-style loans from licensed NC lenders are illegal — though online or out-of-state lenders may try to work around this.

Payday Lending Ban

North Carolina banned payday lending in 2001 and did not renew the authorization in 2006. Storefront payday lenders are not legally operating in NC. If someone presents you with what looks like a payday loan from a physical location in NC, that is a red flag.

Consumer Finance Act

The NC Consumer Finance Act regulates lenders making small personal loans (typically under $15,000). Licensed lenders must register with the NC Office of the Commissioner of Banks (NCCOB). You can verify any lender's license at nccob.nc.gov.

Credit Reporting

NC follows federal Fair Credit Reporting Act (FCRA) rules. Negative items generally fall off your credit report after 7 years (10 for bankruptcy). If you are building credit with a credit-builder loan, payments are reported to the major bureaus — this is how the product is designed to help you.

Right to Cancel (Rescission)

For loans secured by your home (home equity loans, not unsecured personal loans), federal law gives you 3 business days to cancel. Unsecured personal loans typically do not carry this right, so read carefully before signing.
