Don't fall into these traps.

Seasonal, cash-heavy businesses are a target. What to walk away from:

Merchant cash advances.

These are not loans. A company buys a slice of your future receipts and takes a fixed amount out daily or weekly regardless of whether you earned anything. In a business with a slow winter, that structure is how people lose trucks. Salespeople call these "funding," "revenue advance," or "same-day approval."

Upfront fees before funding.

A legitimate lender does not ask for a large fee to "release" or "process" your approval. Grant application fees are always a scam.

Notario confusion.

In much of Latin America a notario is a lawyer. In California a notary public is not, and cannot give legal or immigration advice. Anyone charging for that is operating outside the law.

A few things are true here that are not true everywhere.

Registration.

A sole proprietor operating under any name other than their own legal name files a fictitious business name statement with the **county clerk** and publishes it. An LLC or corporation registers with the **Secretary of State** and files an annual statement. Lenders check that your registration is current — an expired filing stalls applications regularly.

Contractor licensing.

California is strict. If your trade requires a state license, an unlicensed application is usually a dead application, and the license is what lets you bid the larger jobs that make the loan worth taking.

State guarantee programs.

California operates small-business loan guarantee programs delivered through regional nonprofit corporations. You do not apply for a guarantee directly — you ask the lender whether one could make your application work. Ask out loud; it is not always offered.

Water and ag.

Groundwater rules in the Valley affect what land and irrigation improvements are worth financing. If your loan touches wells, acreage, or irrigation, expect questions and get advice before you borrow.
