Texas Rules Worth Knowing

Texas is an easy state to start a business in and a harder one to carry costs in. Both facts affect financing.

If you operate under a name that is not your legal name, you file an assumed name certificate — a DBA — with the county clerk. An LLC or corporation is formed through the Texas Secretary of State. Many lenders will not open a business account or fund a loan without one or the other, so do this first; it is inexpensive and quick.

There is no state income tax, which is why property taxes are high and why an appraisal notice on a shop or a yard can change your whole cash-flow picture in a single year. If you own the building your business operates from, know when your appraisal district sends notices and know the protest deadline.

Texas licenses consumer lenders and credit access businesses through a state regulator, and the licensing rules are looser than in most states — which is exactly why the storefront advance market is so visible in Laredo.
