WHAT TO AVOID

Don't fall into these traps.

Dorchester County's growth — especially in the Summerville and Ladson areas — has attracted a wave of fast-money lenders targeting working families and contractors. Here is what to watch for:

Payday Loans and Cash Advance Stores

These charge effective APRs that regularly exceed 300%. A $400 loan can easily cost $550 or more when you repay it two weeks later. Rollovers multiply the damage. Credit-builder loans from local credit unions do the same job — building breathing room — without the trap.

Car Title Loans

You hand over your car title as collateral. If you miss a payment, the lender can repossess your vehicle — often within days, with minimal notice. For a contractor or worker whose car is their livelihood, this risk is catastrophic. The Summerville and Dorchester Road corridors have several title-loan storefronts. Walk past them.

Rent-to-Own Stores

These are not loans, but they function like very expensive ones. A furniture set or appliance that retails for $600 can cost $1,800 or more over a rent-to-own contract. The effective interest rate is rarely disclosed clearly.

High-Fee Tax Refund Anticipation Loans

Around tax season, watch for lenders offering instant access to your refund for a fee. The IRS direct deposit is usually within 21 days — free. A refund anticipation loan charges for that wait.

'Credit Repair' Companies Charging Upfront Fees

No company can legally charge you upfront to repair your credit under the Credit Repair Organizations Act. Any legitimate help is available free through local CDFIs, nonprofits, and the SC State Housing Finance and Development Authority.

Online 'Quick Approval' Installment Lenders

Many online lenders targeting SC residents operate under tribal or out-of-state charters specifically to avoid SC's interest rate caps. If a lender's rate is 60%, 100%, or higher, SC's 18% general cap likely does not apply to them. South Carolina has specific consumer lending laws you should know before signing anything:

Interest Rate Cap

South Carolina imposes a maximum interest rate of 18% per year on most consumer loans under the South Carolina Consumer Protection Code (Title 37 of the SC Code of Laws). However, payday lenders and some licensed special lenders operate under separate statutes that allow much higher effective rates — this is why it matters who you borrow from, not just how much you borrow.

Payday Lending Regulation

SC allows payday lending under the South Carolina Deferred Presentment Services Act. Payday loans are capped at $550 per loan, with a minimum 14-day term. However, a single loan can still carry triple-digit APR. There is a statewide database to prevent borrowers from having more than one payday loan at a time — but the debt trap is real regardless. Avoid these if at all possible (see Section 6).

Title Loan Caution

South Carolina is one of the states with relatively loose title-loan regulation. Car title loans are legal and common in the Summerville and St. George corridors. They are secured by your vehicle, and repossession can happen quickly. See Section 6 for more detail.

Credit Reporting Rights

Under federal law (FCRA) and reinforced by SC consumer protections, you have the right to a free annual credit report from each of the three major bureaus. You can dispute errors. SC Homestead Exemption
