Identity & Legal Status

  • Government-issued photo ID (driver's license, passport, or consular ID)
  • Social Security Number or ITIN
  • If incorporated: Articles of Incorporation or LLC Operating Agreement, EIN from the IRS

Financial History

  • Last 2 years of personal tax returns (and business returns if filed separately)
  • Last 3–6 months of bank statements (personal and business)
  • Profit and loss statement (a simple income-minus-expenses summary is fine for many microloans)
  • For self-employed contractors: 1099s, invoices, or a Schedule C from your tax return

Business Plan or Use of Funds Statement

  • Not always a formal document — sometimes a one-page explanation of what the money is for and how you will repay it is enough for a microloan

Collateral (sometimes)

  • Equipment, vehicles, or real estate you own may be used as collateral. Some microloan programs require no collateral at all.

WHAT TO AVOID

Don't fall into these traps.

Not every lender has your best interest in mind. Here are patterns to watch for in Flagler County and across Florida:

Merchant Cash Advances (MCAs)

A merchant cash advance is not a loan — it is a purchase of your future revenue at a steep discount. Effective annual percentage rates on MCAs can exceed 100–300%. They are legal in Florida but are almost never the right choice for a small contractor or investor. If someone approaches you with an MCA, get a second opinion from your SBDC advisor first.

Upfront Fee Demands

Legitimate lenders do not ask for large upfront fees before approving your loan. Application fees of $25–$100 are normal. Demands for hundreds or thousands of dollars before you see any money are a warning sign.

'Guaranteed Approval' Marketing

No legitimate lender guarantees approval before reviewing your application. This language is a classic bait-and-switch tactic.

Confusing Loan Terms

Always ask for the APR (Annual Percentage Rate), not just the monthly payment or the 'factor rate.' Factor rates are used by MCA companies to obscure the true cost. If a lender cannot or will not tell you the APR, walk away.

Deed-Based or Title-Secured Loan Schemes

In real estate-heavy areas like Flagler County, some predatory lenders offer short-term loans secured by your property deed, with terms designed to result in foreclosure. If a lender is asking for access to your deed or title on an unusual or very short-term loan, consult a real estate attorney before signing.

Pressure to Sign Quickly

A legitimate lender gives you time to read the documents. If someone tells you the offer expires in 24 hours or pressures you to sign without reviewing, that is a red flag — not a feature.

Florida Small Business Emergency Bridge Loan Program

Administered by the Florida Department of Economic Opportunity (now FloridaCommerce), this program provides short-term, interest-free bridge loans to small businesses impacted by declared disasters. Flagler County, being coastal, has used this program after hurricane events. Loans are typically $1,000–$50,000 and are meant to bridge the gap until insurance or federal disaster funds arrive. Florida Opportunity Fund (FOF)

The Florida Opportunity Fund is the state's CDFI fund. It provides capital to CDFIs across Florida, which then lend to small businesses. If a local CDFI tells you their funds are limited, FOF is a reason new capital may become available — it is useful background to know.

Florida's Usury Law

Florida caps interest rates on most consumer and business loans. For loans under $500,000, the legal maximum interest rate is 18% per year (Florida Statute §687.02). For loans above $500,000, the cap is 25%. If any lender quotes you a rate above these thresholds on a standard loan, that is a serious red flag.

Contractor Licensing

If you are a solo contractor in Flagler County, Florida requires a state-issued contractor's license for most trades. Some lenders — especially SBA-backed ones — will ask to see your license as part of the business documentation. Make sure your license is current before applying.

No State Income Tax

Florida has no personal state income tax, which simplifies your tax returns and may make it easier to demonstrate take-home income to a lender.
