WHAT TO AVOID

Don't fall into these traps.

Rent-to-own and land contracts.

A contract for deed leaves the seller on the title while you make payments and repairs. Miss a payment and you can lose both the house and everything you put into it, with far less protection than a mortgage borrower has. This is the single most damaging trap for buyers who were told they cannot qualify.

Foreclosure rescue and "we buy houses" pressure.

Anyone who offers to take title to save you, or asks you to sign a deed you have not had reviewed, is taking your equity. Non-judicial foreclosure makes Georgia homeowners a target for exactly this.

Upfront fees before a written estimate.

Legitimate institutions give you a Loan Estimate on a standard federal form. Someone collecting a large fee before that form appears is not lending you money.

Contractor financing signed at the kitchen table.

Roof and HVAC salespeople sometimes arrive with a loan and a lien attached. Never sign financing on the same visit as the sales pitch.

Payment-only sales talk.

"It's only this much a month" hides the term, the rate, and whether taxes and insurance are included. Ask for the total and the term in writing.

Georgia Rules That Change How Your Closing Works

Georgia is an attorney-closing state. A licensed Georgia attorney conducts the real estate closing and handles the title work. The attorney represents the lender, not you, which is worth knowing before you walk in — you may hire your own if anything about the deal is unusual.

Security deeds, not mortgages.

Georgia uses a security deed, and it carries a power of sale. That is the mechanism behind the next point.

Foreclosure here is fast.

Georgia allows non-judicial foreclosure, meaning no court hearing is required for a lender to proceed. Compared with judicial states, the timeline from missed payments to a sale date is short. If you ever fall behind, call the servicer and a HUD-approved counselor immediately rather than waiting for a letter you understand.

Homestead exemption.

Once the home is your primary residence, file for the homestead exemption with the county tax commissioner. There is an annual deadline, so ask about it the month you close — it lowers your property tax bill and therefore your escrow payment.

Contractor licensing.

If you are financing a renovation, Georgia licenses electricians, plumbers, and heating and air contractors, and licenses general and residential contractors above a size threshold. Verify a license before you sign a construction or improvement contract.

Down-payment help.

Georgia's state housing finance agency runs first-time buyer assistance through participating lenders. You apply through the lender, not the agency, so ask whether they are a participant.
